This outlines the relationship between ‘You: the Customer and ‘We/us:’ Artists With HeArt CIC trading as www.WithHeArt.org.uk By placing an order via this website, you confirm that you have read and accept these terms and conditions. If you do not agree to these terms and conditions please do not use this website.
1. INTRODUCTION TO WHAT WE ARE
We are not a commercial retail body. We are not the printer of the products.
We are a volunteer led not-for-profit with no employees. The rights to sell prints of their work has kindly been donated by our contributing artists, to enable us to raise funds for our main cause – funding holidays for families.
The artworks displayed on the Home page of this website is sold as art prints. The originals may be available if you contact the artists directly. We do all we can to ensure you have a good experience and that you are completely happy with your purchase.
2. BUYING THROUGH THIS WEBSITE

We aim to accurately describe the artwork and the product you are purchasing. There is more information about our products, paper, printing process and pricing here.
Placing your order
Once you have placed an order with us (by choosing an item and completing our online checkout process) we will email a confirmation of your order. This may go to your spam folder. At that point you have created an agreement to purchase.
It is your responsibility to ensure that all details provided are correct, including the item and quantity required, the delivery address and postcode you wish to use and the email you give us so we can communicate with you about the order (e.g. Confirmation and delivery information).
Our acceptance of your order becomes effective when the confirmation email has been issued.
However, we may not be able to accept or process an order if the following occurs:
1. we cannot obtain authorization for your payment
2. you do not meet any delivery/location criteria set out in our terms and conditions
3. a fault occurs within our website or that of the 3rd party card processing company.
Cancellations
In order to keep costs and waste to a minimum (and raise more funds for our primary cause) we operate on a ‘print to order’ basis. That means we do not hold stock of any item and your order is printed specifically for you. We commit your order to the printer’s system and therefore we become liable for the purchase ourselves. That means your order with us cannot be cancelled once the order confirmation has been issued.
If it transpires you have made an error in your order (wrong item ordered or wrong address for dispatch, etc.) please contact us immediately by email, marking it URGENT in the subject heading. Please provide full details of the order/item. If the item has not already been printed we will endeavour to assist by manually amending the order if possible – but no cancellation or refund is possible.
We are not obliged to provide a refund or replacement for late or non-receipt of orders where the wrong size or item has been ordered, or the recipient address has been misspelled or entered incorrectly by you. You can make changes to your order before you complete the checkout process. Please check your order carefully.
If we or the print system has caused an error we will do our utmost to correct it, or replace the item. Please see item 4. below.
The prints we produce are created using a reliable quality print process, by a print company that specialises in creating prints for artists and photographers. The prints are on premium acid-free art papers. All the images have gone through a printed proof vetting stage before being uploaded to the website. We also ensure the image files used are of good resolution. Therefore the reproduction and colour rendering is as good as it is possible to make it.
However occasionally there may be slight differences in tones between what you see on the website and what is printed. This is because it is almost impossible to match what is displayed on a back-lit screen and the final print. The image you see on your device may also differ from our or any other device. In the circumstances we will only consider issues raised regarding a significant and noticeable difference, or errors in the image rendered as a print.
You are able to access and order a product without registering with us. We will give you the choice upon completion of your order to register with us if you wish. See our Privacy Policy regarding how we hold your information and how we protect your privacy.
For the purpose of ensuring that our payment process is secure (we do not see or hold any card details), we use a 3rd party to process card payments. We use Paypal as our payment processor. This service is free to you, the customer.
Postage and packaging charges
The prices shown on this website are shown inclusive of postage and packaging charges. The p&p element included covers our costs of postage, packing materials, cellophane sleeves, stickers/labels and any time involved.

You should allow at least 7-10 working days from confirmation of order to receipt. We cannot be held responsible for any delays or disruption to postal deliveries which are out of the control of Artists With HeArt CIC. This can include weather, bank holidays, industrial action or civil unrest/military actions.
Some items offered through our website may be packed and despatched direct from the printer of the product. If this is the case, you will be advised directly by email by the supplier of estimated delivery times.
Using the correct postcode is important to ensure prompt delivery. We will make reasonable efforts to ensure that delivery addresses are adequate but we cannot be held responsible for errors in the supply of such information by you.
We will always despatch your order in perfect condition but occasionally a problem can arise. In the unlikely event that an order is faulty, or it is damaged in production or is found to be the wrong item, we ask you to Contact Us within 14 days of receipt to let us know of the problem. Use the Contact Us tab at the top of the website.
In the event that we agree with your claim you may be entitled to a refund or a direct replacement of your order. Refunds cannot be given if the fault is a result of your own actions such as product misuse, not being home for delivery, incorrect address or damage on opening.
We aim to acknowledge any complaint within 14 working days, and will do our best to resolve it within 30 days. We may ask you to take a photograph of the product or send it back to us to help us take up the issue with our suppliers and avoid any future problems. Should it be necessary, we will then advise you how to return your item.
If you are entitled to a refund, we will reimburse the price you have paid for the product and postage/delivery costs. Alternatively, we may offer to reprint or replace the product free of any charge. Please note it is not our policy to offer both a refund and replacement.
All the images of artwork on the website are copyright to either its originator/owner. You agree not to use any copyrighted material without the express permission of the owner.
You also agree not to use WithHeArt.org.uk directly or indirectly for any unlawful purpose, or to cause distress or offence to any person.
All text, software, photographs, graphics, illustrations, images, page layouts, designs, logos, copyright or other material contained on this website remains the property of the Originator at all times. You do not have permission, except where expressly authorised to do so, to change, copy, store, publish, rent, license, sell or distribute in any way any of these intellectual property rights.
We will always try to ensure that our service is available 24 hours a day. We will not be held liable for any reason if the website is unavailable at any time, or for any period.
We may provide links to other websites, artists and related organisations for your convenience. We do not endorse the contents of those websites and are not responsible for their availability or service. We will not be liable in any way for any loss or damage which you may suffer by using those links, which you do at your own risk.
We may update or vary our terms and conditions from time to time, so please check this section for the latest version whenever you visit our website. We may also update and vary the terms and conditions by giving notice of any such changes on other pages of this website.
